Rebatory Terms of Service

1. Acceptance
By installing or using Rebatory ("the App") on a Shopify store, the merchant operating that store ("Merchant," "you") agrees to these Terms of Service.
2. The service
Rebatory is a store credit, cashback, and VIP loyalty app for Shopify merchants. It tracks store credit balances, issues automated cashback, resolves VIP tiers based on customer spend, and manages referral rewards for the Merchant's own customers ("Customers"). The App is provided for informational and operational purposes as part of the Merchant's own store — it is not itself a payment processor and does not hold Customer funds.
3. Merchant responsibilities
You are responsible for configuring cashback rates, VIP tiers, and referral rewards accurately, and for complying with Shopify's own Acceptable Use Policy and API License and Terms of Use while using the App. You are responsible for obtaining any consents required by applicable privacy law before the App processes your Customers' personal data, and for any store credit, discount, or promotional obligation the App's configuration creates toward your Customers.
The App is not directed at children. If your store's customers may include children under 16, you are responsible for ensuring your own use of the App complies with applicable children's privacy law (e.g. GDPR, COPPA) for that data.
4. Store credit is your liability, not ours
Rebatory tracks and displays store credit balances on your behalf. It does not process payments, hold Customer funds, or itself redeem store credit at checkout — that is a function of your Shopify store and payment processor. Store credit balances the App reports are your liability as the merchant of record, not Rebatory's.
5. Fees & billing
Subscription fees are billed through the Shopify Billing API at the plan tier you select in the App's Billing screen. Fees are non-refundable except where required by applicable law. Changing plans takes effect as described on that screen; overage fees (where applicable to your plan) are billed the same way.
6. Third-party services
The App operates on top of Shopify's platform and relies on Shopify to function; Rebatory is not responsible for Shopify's own availability, policies, or acts. See our DPA for the limited set of other service providers (sub-processors) involved in running the App.
7. Data processing
What Customer personal data the App processes and why is described at our Privacy Policy. The terms governing that processing on your behalf are in the Data Processing Agreement.
8. Intellectual property
Rebatory and its operator retain all rights, title, and interest in the App itself. You're granted a limited, non-exclusive, non-transferable license to use the App on your store for as long as it remains installed and these Terms are in effect. You retain ownership of your own store and Customer data.
9. Term & termination
These terms apply for as long as the App is installed on your store. Uninstalling the App ends the agreement; Customer personal data is erased as described in the Privacy Policy and DPA.
10. Disclaimer of warranties
The App is provided "as is," without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement, except as otherwise required by applicable law.
11. Indemnification
You agree to indemnify and hold harmless Rebatory's operator from any claim arising out of your use of the App in violation of these Terms, of applicable law, or of a Customer's rights — for example, configuring rewards you fail to honor, or processing Customer data without a lawful basis to do so.
12. Limitation of liability
To the maximum extent permitted by law, Rebatory's total liability arising out of or relating to the App is limited to the fees you paid for the App in the twelve months preceding the claim, and excludes indirect, incidental, or consequential damages.
13. Changes to these terms
We may update these terms from time to time. Continued use of the App after an update constitutes acceptance of the revised terms.
14. Company information & governing law
Rebatory is operated by Maurice Samba, Große Bergstraße 17, 30989 Gehrden, Germany. These Terms are governed by the laws of Germany, without regard to conflict-of-law principles.
Rebatory is currently operated as a sole proprietorship. If the business is later registered as a company, this section will be updated with the registered business name and any applicable trade-register details.
